Are you able to register a TM even if you have nothing to do with it.  Like say for example you wanted to TM thefoodpalace but you didnt own any food domains or anything having to do with that would you still be able to TM it?

As long as no one has filed for a vTM on it you should be able too. If it is not filed then no one has a right to it yet.
