What everyone should know about trademarks

Since trademarks have dropped in price, it's infinitely important to do your homework before registering a trademark or domain name. I'm here for representation or consulting.

I strongly suggest that you do a little researching on the internet or by talking to me before you take on a dispute. There are two very important issues at hand, and you should be aware of each:

Cyberbullying: This is when someone tries to register a trademark to force you out of a domain name.

Cybersquatting: This is the opposite, when someone registers a domain name with the intent to sell it back to the trademark owner.

Know your rights, protect yourself!

Please remember that disputes about these matters don't need to get personal, it's all just a game.

There are also a couple of issues related to what constitutes trademark infringement. For example, if the trademark is different, but creates reasonable confusion, such as "elephantParty.com" vs. "elefantParty.com", there could be an issue. Remember that common words and phrases are harder to trademark.

 since there is no class system for what you are filing a TM for filing a TM for somthing would give you rights to anything that deals with. so if u own a domain and somone Holds the TM for for it with or with out the TLD it belongs to the TM holder

Ultimately that's one of the flaws with a simulation, since this isn't a full legal system, it's really going to depend on compuXP's interpretation of the law (from this point on). There really shouldn't be such a wide opportunity for "Cyberbullying", or things could get really tough. That way anyone with $20 could have virtually any domain they wanted at this point, since so few have been registered. That really doesn't reflect the spirit of the game.
